How current is this English edition?

It reflects the Korean text enforced on 2 January 2026 (Act No. 21065). It is based on the last official English translation (Act No. 18244, 2021) and incorporates every amendment made since, with substantive changes highlighted. Amendments not yet in force as of 2 January 2026 are not included.

What has changed since the 2021 translation?

The March 2025 amendment restructured foreign exchange brokerage — adding a definition of "foreign exchange brokerage affairs" (Article 3 (16-2)) and rewriting Article 9 into "general" and "customer" foreign exchange brokerage business with investor- and financial-consumer-protection provisions applied mutatis mutandis. And in the 2 January 2026 government reorganization, the competent authority became the Minister of Finance and Economy.

Why does the text refer to the "Minister of Finance and Economy"?

Under the reorganization effective 2 January 2026, the former Ministry of Economy and Finance was reorganized and the authority competent for foreign exchange became the Ministry of Finance and Economy (MOFE). The Act therefore refers to the "Minister of Finance and Economy" where the 2021 translation referred to the "Minister of Economy and Finance."

What does the Act cover?

The foreign exchange regime and definitions; foreign exchange agencies, specialized dealers and brokerage; the Foreign Exchange Equalization Fund; payments, receipts and capital transactions; supervision and reporting; and penalty provisions and administrative fines.
