Frequently asked questions

Is the foreign investor Investment Registration System still required in Korea?

No. The foreign investor Investment Registration System was abolished on 14 December 2023. Foreigners may now invest in Korean listed securities without prior registration with the FSS. The guidebook explains the transition and the account-opening and reporting procedures that apply afterward.

What foreign ownership limits apply to Korean listed stocks?

Public corporations designated under the FSCMA are subject to an aggregate foreign-ownership limit (for example, the Korea Electric Power Corporation at 40%), and around 31 corporations have foreign acquisition limits set under other statutes — such as 49% for facilities-based telecommunications operators under the Telecommunications Business Act. The guidebook sets out the concept, the calculation basis, and the exceptions.

What does the guidebook cover?

Chapters I–VI plus a Q&A: an overview of the foreign investment regime; foreign ownership limits on listed stocks; the abolished Investment Registration System, account opening and required documents; the listed-securities trading regime and OTC-transfer reporting; penalty provisions; and a practical Q&A.

How current is this English edition?

It reflects the FSS Korean edition issued in April 2026 and incorporates all amendments through that date, including the December 2023 abolition of investment registration and the January, March and April 2026 changes to the foreign omnibus account and OTC-transfer reporting.
